Foldvia Terms of Service

These Terms of Service ("Terms") govern your use of the Foldvia desktop application ("Foldvia", the "App"), published by Laventis Strategic Ltd (元構策略有限公司) ("Laventis", "we", "us"), a company registered in Taiwan (R.O.C.). By installing or using the App, you agree to these Terms.

1. The service

Foldvia is a local-first desktop application that lets you connect your own third-party cloud-storage accounts (such as Google Drive) and browse your files across them in a single unified view. The App runs on your device and communicates directly with each cloud provider's API; we do not operate a server that handles your cloud file contents or metadata.

Because the App runs on your device, the security of that device is your responsibility. We are not liable for loss, corruption, or disclosure of data caused by malware or unauthorized software on your device, by compromise of your operating-system account, or by leakage of your cloud credentials or encryption keys.

Your use of features that connect to Google services is additionally subject to Google's applicable terms.

Foldvia's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

4. Acceptable use

You agree not to use the App to: violate any law or any cloud provider's terms; access data you are not authorized to access; or interfere with, disrupt, or attempt to gain unauthorized access to any provider's systems.

5. Intellectual property

The App, including its name, logo, and software, is owned by Laventis and its licensors. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use the App. Your files and data remain yours; we claim no ownership over them.

6. Third-party services

Foldvia interoperates with third-party cloud providers that we do not control. We are not responsible for those services, their availability, or their handling of your data under their own terms and policies.

7. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any file representation is complete. Foldvia surfaces honest "evidence" indicators about how strongly a file's status was verified; you should not treat the App as a substitute for your own backups.

8. Limitation of liability

To the maximum extent permitted by law, Laventis will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the App is limited to the total amount you actually paid us for the App during the twelve (12) months preceding the event giving rise to the claim. If you have not paid us anything for the App, that limit is NT$3,000.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited under the applicable law of your place of residence.

9. Termination

You may stop using the App and uninstall it at any time. We may suspend or terminate the App or these Terms where required by law or to protect the service or its users.

10. Changes

We may update these Terms. Every change is posted at this URL with an updated revision date in the revision history at the end of this page.

For material changes we will additionally show a prominent notice inside the App, so that you are informed before the change affects you rather than only by our publishing it here. Continued use after a material change takes effect constitutes acceptance.

11. Governing law and jurisdiction

The interpretation, validity, and performance of these Terms are governed by the laws of the Republic of China (Taiwan), without regard to conflict-of-laws principles. For any dispute arising out of these Terms or out of your use of the App, the parties agree that the Taiwan Taipei District Court shall be the court of first instance, without prejudice to any mandatory jurisdiction that consumer-protection law confers on you.

13. Language

The Traditional Chinese version of these Terms is the authoritative version. This English text is provided as a translation for convenience. In the event of any discrepancy between the two, the Traditional Chinese version prevails.
